This Legal Notice regulates the use of this website, https://www.azfacadiz.es/, whose owner is the Cádiz Free Trade Zone Consortium, hereinafter CZFC, with CIF Q-1176004H, Social Headquarters Building, Ronda de Vigilancia, s/n 11011 Cádiz. Telephone: 956290606.

The purpose of this Legal Notice is to establish and regulate the rules of use of the website. The use, access, navigation and viewing of content hosted on the website attributes the status of User to the same and implies acceptance of all the conditions included in this Legal Notice.

The User undertakes to carefully read this Legal Notice on each occasion on which he or she intends to use the Site, since it and its conditions of use included in this Legal Notice may be subject to modifications.

The Zona Franca de Cádiz Consorcio reserves the right to make, without prior notice, any modifications it deems appropriate to its Website, and may change, delete or add both the content and services provided through it and the way in which they appear presented or located on its servers.

2. Intellectual and industrial property

The content published through the CZFC websites - including, but not limited to, databases, images, photographs, drawings, graphics and texts - are the property of the CZFC or the content providers assigned to the CZFC; being that all of them are subject to protection by national, community and international standards on intellectual and industrial property rights. Likewise, the compilation, design, arrangement and assembly of the content of the websites is the property of CZFC.

Without prejudice to the provisions of Law 19/2013, of December 9, on Transparency, access to public information and good governance, the contents of the CZFC websites may not be modified, copied, transformed, altered, reproduced or adapted by third parties without express authorization from the owner of said content. The making available of content does not imply in any case the transfer of ownership or the granting of any right of exploitation in favor of the user, other than the right of use that entails the legitimate use of the websites.

3. User responsibilities regime

The user undertakes to carefully read this LEGAL NOTICE of the websites owned by the Cádiz Free Trade Zone Consortium (hereinafter CZFC) on each of the occasions in which he intends to use them, given that these and their conditions of use may be subject to modifications. The CZFC reserves the right to make, without prior notice, the modifications it deems appropriate in each of its websites, which may affect changes, deletions or additions in the presentation, in the contents or in the way in which they appear located on its servers.

Likewise, to be able to use and browse the CZFC websites, the user must be of legal age or at least 16 years of age and have the consent of their legal guardians. Likewise, the user undertakes that the information provided to the CZFC is true, lawful, accurate and complete, and undertakes to keep it updated.

The user must not use the information and services obtained through the CZFC websites in a manner contrary to what is established in this Legal Notice, in its Privacy Policy, in the national and community legislation that is applicable, as well as in customs and good practices, in such a way that said use does not imply injury to the rights of the CZFC or third parties.

In the event that the user does not agree with the terms of this Legal Notice, they must refrain from using the information and services offered through the CZFC websites.

4. Limitation of CZFC's liability for the use of the websites

Third party advertisers, sponsors or collaborators of the CZFC will be solely responsible for the content they integrate into their corporate websites; CZFC abstains from liability for errors, inaccuracies and irregularities included in such content.

If at any time any of these errors appear, the CZFC will proceed to correct them as soon as possible, informing the user of the correction and the options established in current legislation.

The CZFC will not be responsible to the user in the following cases:

    • about the effectiveness and speed of the access connection to the websites;
    • about interferences, omissions, interruptions, malware, breakdowns, disconnections or other incidents linked to the operation and availability of the websites;
    • about the information provided or entered by the user himself or by third parties outside the CZFC with whom he does not have any agreement or collaboration;
    • on non-compliance by users residing in third countries with respect to non-compliance with the legislation of their respective countries of origin.

5. Hyperlinks and links

The owners of other websites who wish to create hyperlinks to the CZFC websites undertake not to establish links to websites on which the CZFC logo does not appear, as well as not to make false, inaccurate or incorrect statements that may be misleading or, in general, contrary to current legislation.

Asimismo, se comprometen a no establecer enlaces con sitios web con contenidos, manifestaciones o propaganda de índole racista, xenófoba, pornográfica, de apología del terrorismo, que inciten al odio o a la comisión de cualquier actividad delictiva y, en general, que sean conrtarios al ordenamiento jurídico nacional, comunitario o internacional; as well as those that may harm in any way the good name and image of the CZFC.

The inclusion of hyperlinks does not necessarily imply that the CZFC maintains relations with the owner of the linked website.

The presence of hyperlinks on the websites has a purely informative purpose, which is why the CZFC is not responsible or grants any guarantee of any nature, either express or implied, regarding the marketability, suitability, quality, characteristics, origin, commercialization or any other aspect of the information, products and/or services.

6. Technical security measures applied

Corporate web domains are protected by an SSL/TLS certificate issued by a certification authority and with an X9.62 ECDSA signature algorithm with SHA-384, which guarantees the confidentiality, integrity, availability, authenticity, traceability and privacy of the information contained and provided on its websites.

Likewise, it maintains implemented and updated the security measures referred to in Annex II of RD 311/2022, of May 3, which regulates the National Security Scheme (ENS).

7. Express submission clause

For the resolution of all disputes or issues related to this website or the activities carried out on it, Spanish legislation will apply, to which the parties expressly submit, with the Courts and Tribunals of the city of Cádiz being competent to resolve all conflicts arising from or related to its use, except in those cases in which the regulations on consumers and users establish a different jurisdiction.
